Volunteer terms, conditions, waiver and release from liability
I understand that if I volunteer for The Bloody Long Walk 2021 (the "Event"), for the Mito Foundation (incorporated as the Australian Mitochondrial Disease Foundation Limited ("AMDF")) I must comply with the following terms and conditions, without reservation:
APPLICATIONS TO VOLUNTEER
- The following table sets out the relevant dates and location for the Event:

- The allocation of volunteer roles for the Event is by application only.
- I accept that if I am interested in volunteering for the Event, I must complete the volunteer application form on bloodylongwalk.com.au (the ‘’Application’’). Should the Event Organiser accept my Application, I will receive a confirmation and details of my allocated position for the Event by email.
- I acknowledge that the Event Organiser reserves the right to refuse my Application and is under no obligation to explain why any particular Application has been unsuccessful.
- I understand that if I receive a confirmation email from the Event Organiser I will then be considered a volunteer for the Event ("Event Volunteer") by the Event Organiser and their authorised representatives and must comply with all obligations of Event Volunteers as detailed below.
- I accept that at any time between the confirmation date and the date of the Event, I must advise the Event Organiser if I am no longer available to volunteer during the Event.
- I accept that Event Volunteers are not employees, agents or contractors of AMDF. I accept that at no time may I represent to any third party that I am an employee, agent or contractor of AMDF and instead must clearly make it known that I am a volunteer.
AGE LIMITS
- I understand that all Event Volunteers and any persons accompanying Event Volunteers to the Event must be 12 years or older.
- I certify that:
- I am 18 years or older; or
- if the Event Volunteer is between 12 years and 18 years old:
- I am the parent/legal guardian of the Event Volunteer who is under 18 years;
- I have read this document and fully understand it;
- I agree to these terms and conditions for and on behalf of the Event Volunteer; and
- I will accompany the Event Volunteer to the Event and remain with the Event Volunteer at all times during the Event.
- If I am an Event Volunteer over the age of 18 years and I attend the Event with a person under the age of 18 years (a "Minor"), I understand and certify that:
- the Minor(s) that will accompany me will be at least 12 years old; and
- I will be responsible for the safety and actions of the Minor and ensure the Minor behaves in accordance with the spirit of these terms and conditions; and
- I, on behalf of the Minor:
- accept all risks necessarily flowing from the Minor's attendance at the Event, including but not limited to loss of life or permanent injury, and
- to the extent permitted by law, waive all and any claim, right or cause of action which the Minor might otherwise have arising out of the death, injury, damage or loss of any description whatsoever that the Minor may suffer or sustain in the course of, or consequent upon the attendance of the Minor at the Event or as a result of any acts or omissions whether negligent or otherwise of AMDF, the Event Organiser, their authorised representatives or any other party involved in the Event.
INFORMATION BRIEFING
I understand that Event Volunteers will be sent a written brief one week prior to the event and also verbally briefed prior to their volunteer shift commencing.
REGISTRATION, MEALS, PARKING AND COSTS IN RELATION TO THE EVENT
- I understand the Event will be held outdoors and is expected to proceed notwithstanding poor weather. However, I understand the Event Organiser reserves the right to postpone or cancel the Event at any point and if this occurs, Event Volunteers will be notified as soon as practicable.
- I accept that Event Volunteers will be allocated a start time from which they will commence their volunteering duties.
- I accept that Event Volunteers must sign in on the day of Event at the designated registration area at least 15 minutes prior to their allocated start time.
- I accept that AMDF, the Event Organiser or their authorised representatives will provide Event Volunteers who volunteer during the lunchtime period (noon – 2pm) with a meal (or meal voucher) and water on the day of the Event.
- I accept that AMDF will not provide parking for Event Volunteers for the Event. I accept that it is my responsibility to locate suitable parking before or during the Event.
- I acknowledge that AMDF, the Event Organiser or their authorised representatives are under no obligation whatsoever regarding any costs to me, including transportation to and from the Event.
- I accept all responsibility for my own safety and the security of my belongings at all times.
GENERAL VOLUNTEER OBLIGATIONS
- I accept that as an Event Volunteer, I am required to:
- commit to and complete Event Volunteer activities in accordance with the agreed availabilities, role description and working arrangements;
- attend induction activities (if any) and participate in training activities (if any) as required by the Event Organiser and their authorised representatives;
- respect and follow the reasonable directions of the Event Organiser and their authorised representatives at all times, including during induction and training events (if any) and on the day of the Event;
- perform all tasks and activities assigned to me in a responsible and conscientious manner, to the best of my ability, and in accordance with any applicable Commonwealth and State laws and relevant AMDF policies, guidelines, practices and procedures;
- respect the property and resources of the Event Organiser and their authorised representatives, Event participants and other Event Volunteers;
- not be under the influence of drugs or alcohol at any time during my participation in the Event, including during induction, training and on the day of the Event and I understand that consumption of alcohol or drugs will result in the immediate termination of my services;
- act in a safe, responsible and courteous manner at all times, including during induction, training and on the day of the Event;
- follow the directions of any police, emergency service personnel and local council officers during the Event;
- wear/use personal protective equipment and other items when provided/issued by the Event Organiser or their authorised representatives;
- follow good occupational health and safety practices and work collaboratively to create a safe working environment for everyone at all times, including during induction, training and on the day of the Event;
- report any unsafe work incidents or accidents to the Event Organiser or their authorised representatives at any time, including during induction, training and on the day of the Event;
- provide truthful and accurate information to the Event Organiser, their authorised representatives, Event participants, other Event Volunteers and community members;
- comply with and complete any necessary background checks (if required), including checks in relation to prohibited employment and working with children;
- respect and appreciate the nature of confidential information (if issued with such information); and
- commit not to issue any statement to the media without the written consent of the Event Organiser or their authorised representatives.
ADDITIONAL OBLIGATIONS AND AGREEMENT WITH RULES
- I accept that Event Volunteers are expected to act in accordance with AMDF's standards, policies and procedures at all times during induction and training events (if any) and on the day of the Event.
- During the Event, I agree to abide by the directions of AMDF, the Event Organiser or their authorised representatives and complete my duties as an Event Volunteer with care and consideration of other volunteers, Event participants and spectators.
- During the Event, I also agree to comply with all obligations and guidelines relevant to the Event of the relevant authorities, councils and AMDF.
- I accept that at no time may I grant special privileges to any person or group, and must avoid all other conflicts of interest which may arise from my position as a volunteer.
- I agree to read all Event Volunteer rules, regulations and conditions and conform to them.
- Without limiting Clause 30 below, I acknowledge that AMDF, the Event Organiser or its authorised representatives may remove me from the Event area, exclude me from participation as an Event Volunteer and/or discontinue my relationship with AMDF:
- if my behaviour is illegal, dangerous, inappropriate, offensive, abusive or does not uphold AMDF’s standards;
- to prevent damage to any property;
- on medical or health and safety grounds (including to prevent possible harm or injury to myself or any other person);
- if I am or I appear to be under the influence of alcohol or drugs;
- to prevent or arrest any form of unauthorised marketing, including ambush marketing; or
- on any other reasonable grounds.
- AMDF and the Event Organiser reserve the right to terminate the services of any Event Volunteer in their sole discretion at any time.
MEDICAL INFORMATION
- I acknowledge that I should seek medical advice prior to participating as an Event Volunteer during the Event if I have suffered or I am suffering from a medical condition.
- I consent to receiving any medical treatment that the Event first aid safety manager (the ‘’First Aid Safety Manager) or his/her authorised representatives consider necessary or desirable during or after the Event.
- I acknowledge that I will write an emergency contact name and phone number when requested by AMDF, the Event Organiser or their authorised representatives and agree that AMDF, the Event Organiser or their authorised representatives may contact that person and exchange my personal information with them in case of an emergency.
RISK, INSURANCE AND WAIVER
- The decision to participate as an Event Volunteer is entirely my own. I attest that I am physically and mentally fit to undertake my role as an Event Volunteer and that I am not aware of any illness, injury, physical disability or impairment which may cause me injury or death during or as a consequence of my participation as an Event Volunteer.
- I agree that upon becoming aware of any medical condition or impairment that may affect my own safety or the safety of others or becoming aware that I am no longer physically or mentally capable of undertaking my role as an Event Volunteer at any point prior to or during the Event, I will immediately notify the Event Organiser or their authorised representatives.
- I accept all risks necessarily flowing from my participation as an Event Volunteer, including but not limited to loss of life or permanent injury. I, in consideration of, and as a condition of acceptance of my participation as an Event Volunteer for myself, my heirs, executors and/or administrators hereby waive all and any claim, right or cause of action which I might otherwise have arising out of my death or injury, damage or loss of any description whatsoever I may suffer or sustain in the course of, or consequent upon my participation as an Event Volunteer or as a result of any acts or omissions whether negligent or otherwise of AMDF, the Event Organiser, their authorised representatives or any other party involved in the Event.
- This waiver, release and discharge shall be (and operate separately) in favour of all persons, corporations and bodies involved, or otherwise engaged in promotion or staging the Event (including but not limited to AMDF) and each of their directors, officers, agents, contractors, employees, servants, representatives, promoters, sponsors, including medical and paramedical personnel appointed for the Event, the owners, licensees and occupiers of land upon which the Event or any part of it takes place, any statutory body or local authority having control over any land upon which the Event or any part of it takes place or which is involved directly or indirectly with the Event in any manner whatsoever. This release and indemnity continues forever and binds my heirs, executors, personal representatives and assigns.
USE OF NAME OR PICTURE
- I accept that Event Volunteers may be photographed/recorded by AMDF, the Event Organiser, the relevant authorities and councils of the Australian State or Territory in which the Event will take place, the Event sponsors and agents, the authorised representatives of these parties, and by members of the public. I give my consent to the photography/recording and to its subsequent use.
- I also consent to the publication and/or use of my name, image, voice, statement or otherwise (including the publication of my name in any broadcast, telecast, advertising, promotion or other account of this Event), in any form of media whatsoever including advertising and promotions for future AMDF events, or for any legitimate purpose without payment or compensation. In the event that I do not consent to the above then I agree to advise the Event Organiser of this in writing no later than one week prior to the Event.
PRIVACY
- AMDF and the Event Organiser respect and value the privacy of all personal information we collect about persons who wish to become Volunteers and other parties.
- I understand that I must read and accept the terms of the privacy policy of AMDF ("Privacy Policy") which is available at, Mito.org.au I understand that the Privacy Policy forms part of these terms and conditions, and explains how the personal information of parties are collected and managed.
- I understand that as the organiser of the Event, AMDF collects personal information about Event Volunteers and other parties for the administration and conduct of the Event. I understand that personal information may be disclosed by AMDF or representatives of AMDF to the First Aid Safety Manager or his/her authorised representatives for delivering medical services to me, in accordance with clause 32 above and to various media, in accordance with clause 39 I understand that personal information may be given to the public relations consultant of AMDF, in relation to my participation at the Event, for generation of media stories with prior consent.
- I understand that personal information collected by AMDF will be securely stored on the database of AMDF.
- I understand that I can gain access to my personal information and make a request at any time that such details be updated if they change in the future by writing to the Event Organiser via the Event Website.
- By entering this Event, I consent to my personal information being provided and used as outlined above and in accordance with the Privacy Policy. I further consent to receiving information (including via email) from AMDF, Everyday Hero, the relevant authorities and councils of the Australian State in which the Event will take place and the Event sponsors and agents, who may use information for their own promotions.
OTHER
- The Event Organiser reserves the right to alter these terms and conditions up to the date of the Event. Any such variations will be posted on the Event Website, which Event Volunteers must review from time to time.
- I acknowledge that a copy of these terms and conditions has made been available to me on the Event Website and that I have read and understood the content.by
- I agree to these terms and conditions, any alterations to these terms and conditions made by the Event Organiser and all other terms and conditions notified to me by AMDF and the Event Organiser, from time to time, in relation to the Event.
ACCURACY
- I declare that all the information supplied by me on this entry form is true and correct.
In this document:
"Event Organiser" means The Shift Corp. and can be contacted via Hailey Mason (hailey.mason@the-shift.agency); and
"Event Website" means www.bloodylongwalk.com.au
